مبدأ الشفافية ورقمنة قطاع الصفقات العمومية

الملخص
: تعتبر الشفافية عنصرا أساسيا لإبرام وتنفيذ الصفقات العمومية ، بحيث يجب أن تتوافر على العلانية بما يتلاءم وخصوصية عقد الصفقة العمومية باعتباره عقدا من العقود الإدارية ،وحيث أنه وجه من أوجه المال العام فقد حرص المشرع على تكريس الشفافية من خلال العديد من الآليات بمقتضى قانون الصفقات العمومية ، ومن بين الآليات التي اعتمدها المشرع لتكريس الشفافية في قطاع الصفقات العمومية تأسيسه للبوابة الإلكترونية حيث حرص المشرع من جهة على رقمنة قطاع الصفقات العمومية ومن جهة أخرى عمل على وضوح الإجراءات والإعلام المسبق للمتنافسين بشأن معايير الاختيار وضرورة الإعلان عنها بالطرق المحددة وتمكيين المترشحين من إيصال عروضهم والاطلاع على نتائج التقييم. . Abstract Transparency is an essential element for concluding and executing public deals, as it must be publicly available in a manner that is consistent with the specificity of the public deal contract as it is an administrative contract. Among the mechanisms adopted by the legislator to establish transparency in the public procurement sector is its establishment of the electronic portal, whereby the legislator was keen on the digitization of the public procurement sector, and on the other hand worked on clarity of procedures and prior notification of the competitors regarding the selection criteria and the necessity of announcing them in the specified ways and enabling the candidates to communicate their offers and see the Evaluation result.. .
