ضمانات حماية المستهلك في عقد الوكالة العقارية Consumer Protection Guarantees In A Real Estate Agency Contract

الملخص

ألزم المشرع الجزائري أن تجسد العلاقة بين المستهلك والوكيل العقاري بموجب عقد وكالة مكتوب، توضح من خلاله التزامات وحقوق كل منهما، وإلا كانت المعاملة باطلة. فعقد الوكالة العقارية هو آلية قانونية لحماية المستهلك بالدرجة الأولى، استحدثها المشرع بموجب المرسوم التنفيذي 09-18 المحدد للتنظيم المتعلق بممارسة مهنة الوكيل العقاري، بعد انتشار ظاهرتي النصب والاحتيال من قبل بعض الوكلاء العقاريين. يهدف هذا البحث لإبراز تدخل المشرع الجزائري لحماية المستهلك المتعامل مع الوكيل العقاري، باعتبار هذا الأخير الطرف القوي في العلاقة، من خلال عقد الوكالة العقارية التي يترتب عنها التزامات في ذمة الوكيل العقاري اتجاه، حيث يؤدي الاخلال بها إلى إقرار مسؤوليته، وهو ما يشكل ضمانة لحماية المستهلك. abstract: The Algerian legislator is obliged to embody the relationship between the consumer and the real estate agent according to a written agency contract that clarifies the obligations and rights of each of them, otherwis the transaction is void. The real estate agency contract is a legal mechanism to protect the consumer in the first place, which the legislator introduced according to Executive Decree 09-18 specified for the regulation related to the practice of the profession of real estate agent, after the spread of fraud by some real estate agents. This research aims to highlight the intrvention of the Algerian legislator to protect the consumer dealing with the real estate agent, considering the latter the strong party in the relationship, throught the real estate agency contract that entails obligations owed to the real estate agent towards the consumer, where breaching it leads to the acknowledgment of his responsibility, which is what constitutes a guarantee for consumer protection.
