الملخص
يتفق شراح القانون أن الحق هو سلطة يقرها القانون لشخص على شيء، و لما كانت حقوق الملكية الفكرية بوجه عام و العلامة التجارية أحد أهم عناصر الملكية الصناعية بوجه خاص أحد أهم هذه الحقوق لكونها تنطوي على فكرة الحقوق الذهنية كونها منوطة بعقل الانسان و هي الوسيلة لزيادة الابداع، و نتيجة لهاته الأهمية المتزايدة سواء على المستوى الوطني أو الدولي أقر المشرع الجزائري على غرار التشريعات الأخرى ضرورة توفير حماية لأصحاب حقوق العلامة التجارية لهذا جاءت فكرة حماية العلامة التجارية بواسطة المعهد الوطني الجزائري للملكية الصناعية و المنظمة العالمية للملكية الفكرية. Jurists agree that the right is an authority established by law for a person over something, and since intellectual property rights in general and trademark are one of the most important elements of industrial property in particular, one of the most important of these rights is that they involve the idea of intellectual rights as being vested in the human mind and is a means of increasing creativity and As a result of these increasing importance, whether on the national or international level, the Algerian legislator, like other legislations, recognized the necessity of providing protection for trademark holders. This is why the idea of protecting the trademark came through the Algerian National Institute of Industrial Property and the World Intellectual Property Organization.
