الملخص
الملخص: إن الحق في حرمة الحياة الخاصة من الحقوق اللصيقة بالشخصية، ما جعل المشرع الجزائري يوضع آليات قانونية لضمان حماية كافية للأشخاص من الانتهاك الرقمي، وتزداد ضرورة الحماية القانونية متى تعلق الأمر بالتشهير الرقمي للأطفال والإساءة إليهم في مواقع التواصل الاجتماعي نظرا لحساسية وضعهم والآثار السلبية المحتملة عليهم، مما يستوجب تشديد العقوبات للجناة، واعتبار العلانية في الأنترنت ظرفا مشددا للعقوبة، بالموازاة مع تكريس حماية قضائية، والتي نص عليها قانون حماية الطفل رقم 15/12 بالإضافة لقانون العقوبات رقم 1/14، ورقم 06/23 والتي تبقى تحتاج المزيد من التدقيق والإثراء من أجل تعزيز سياسة حمائية حقيقية وفعالة للطفل الضحية لتكريس خصوصيته الواقعية بالموازاة مع خصوصيته الافتراضية في ظل استخدامه الواسع لوسائل التواصل الاجتماعي وما ينجر عنه من انتهاكات تستوجب اجراءات حمائية موضوعية واجرائية واضحة تضمن عدم إفلات الجناة من العقاب Abstract: The right to the inviolability of private life is one of the inherent rights of personality, which made the Algerian legislator put in place legal mechanisms to ensure adequate protection for people from digital abuse, and the need for legal protection increases when it comes to digital defamation of children and their abuse on social media sites due to the sensitivity of their situation and the negative effects This requires more severe penalties for the perpetrators, and considering publicity on the Internet an aggravating circumstance, in parallel with the establishment of judicial protection And which were stipulated in Child Protection Law No. 12/15 in addition to Penal Law No. 01/14 and No. 06/23, which remain needing more scrutiny and enrichment in order to promote a real and effective protection policy for the child victim to devote his realistic privacy in parallel with his virtual privacy in light of Its widespread use of social media and the violations it entails require clear objective and procedural protection measures to ensure that the perpetrators do not go unpunished. .
