الملخص
ملخص البحث: العنف المعنوي الزوجي هو حالة الإساءة العاطفية البالغة التي تتعرض لها الزوجة من طرف الزوج، وتسبب لها إنتهاكات تؤثر على نفسيتها وإستقرارها الذاتي مما يسبب لها أضرارا على كافة المستويات، مما جعلنا نتطرق لهذا الموضوع من أجل توضيح آليات حماية الزوجة من العنف المعنوي في القانون الجزائري رقم 15-19 والشريعة الاسلامية، من خلال إشكالية تتركز على مدى فعالية إجراءات حماية الزوجة من العنف المعنوي في إطار الزوجية، وقد تم التطرق لهذا الموضوع من خلال منهج وصفي تحليلي ومقارن بين أحكام القانون الجزائري والشريعة الإسلامية، حيث تم التوصل إلى عدة نتائج منها ضرورة إعادة النظر في القانون المذكور لتحقيق فعالية حمائية حقيقية، مع ملاحظة أن أحكام الشريعة الاسلامية تأخذ بعين الإعتبار وضع إجراءات لمعالجة بوادر الخلافات الزوجية من الطرفين قبل أن تقع فعلا حماية لهما من التمادي ضد بعضهما تعنيفا ونشوزا وشقاقا حفاظا على الميثاق الغليظ الذي هو قوام بقاء الأسرة وديمومة المودة والرحمة. Abstract: Moral marital violence is the marital status of the emotional abuse of the wife to the wife of the husband, causing them violations affect the psychological and self-stability causing harm to all levels, which made us address this issue in order to clarify mechanisms to protect the wife from violence In the Algerian law number 15-19 and Islamic law, through a problem that focuses on the effectiveness of the measures to protect the wife from moral violence in the context of doubles. This topic was addressed through an analytical and comparative descriptive approach between the provisions of the law and Islamic law, To several results from it The need to review the said law to achieve effective protectionism, noting that the provisions of Islamic law take into account the development of procedures to address the signs of marital differences of the parties before they actually occur, and after the protection of them to go against each other, On the Charter, which is the strength of the survival of the family and the continuity of affection and mercy
