مسؤولية الإدارة عن المساس بالإمتيازات المالية للمتعاقد

الملخص
تعتبر المزايا المالية للمتعاقد في العقد الإداري الركيزة الأساسية التي تؤدي إلى تنفيذ العقد الإداري خلال الأجل المتفق عليه، فلا يمكن للإدارة المساس بها إلا وفق قيود، وإلا حق للمتعاقد مقاضاتها أمام القضاء الإداري مطالبا بتعويضه أو إنهاء العقد على حسب الحالة. إن عدم مساس الإدارة بالمزايا المالية للمتعاقد يؤدي إلى توازن العقد وعدم تعطيل المصلحة العامة وسير المرفق العام. The financial benefits of the contractor in the administrative contract are the main pillar that leads to the implementation of the administrative contract during the agreed upon tem, so the management can only affect them according to restrictions, otherwise the contractor's right to be sued before administrative judiciary, demanding compensation or termination of the contract, according to the case. The failure of management to prejudice the contractor leads to the balance of the contract and non-delay the public interest and the functioning of the public facility.
