إشكالية الموازنة بين سلطة الإدارة في التعديل الانفرادي للعقد الإداري وحماية المركز التعاقدي للمتعاقد

الملخص
الهدف من الدراسة هو إبراز أثر سلطة الإدارة في التعديل الانفرادي للعقد الإداري أثناء تنفيذه على المركز التعاقدي للمتعاقد وحقوقه المقررة في العقد المبرم،وكذا بيان حدود هذه السلطة كآلية لحماية حقوق المتعاقد . أن رقابة القاضي الإداري على هذه السلطة تعد آلية فعالة للموازنة بين الامتياز التعاقدي للإدارة في علاقاتها التعاقدية،إلا أنها غير كافية لحماية المركز التعاقدي للمتعاقد وحقوقه المالية. الكلمات المفتاحية:إدارة،متعاقد،تعديل، انفرادي،عقود،إدارية. Abstract The research on this subject purpose is to define of the authority of the Administration on the unilateral modification of the administrative contract during its implementation of the contractual status and rights of the contractor in the contract concluded, as well as the statement of its limits as a mechanism for the protection of the rights of the contractor. That the control of the administrative judge of this authority is an effective mechanism for balancing the contractual privilege of the Department in its contractual relations, but is not sufficient to protect the contractual status and financial rights of the contractor.
