استقرار العقود وحفظ الحقوق في الاقتصاد الإسلامي

الملخص
حرصت مبادئ الاقتصاد الإسلامي على استقرار العقود والمعاملات المالية وحفظ الحقوق وتثبيتها بين المتعاقدين، يهدف هذا البحث إلى بيان عدد من التشريعات التي عملت على تحقيق استقرار العقود، كما يسعى لإبراز عدد من الأحكام والتشريعات التي تحمي حقوق الناس وتمنع الإضرار بهم. واتبع الباحث في هذه الدراسة المنهج الاستقرائي بتتبع بعض النصوص الشرعية ذات الصلة وكذلك المنهج الاستنباطي لتحليل هذه النصوص والأحكام وبيان دورها في استقرار العقود وحفظ الحقوق، وقد خلصت الدراسة إلى أن منظومة التشريع في الاقتصاد الإسلامي قد ضمت عددا من التشريعات والأحكام التي عملت على توثيق الحقوق واستقرار العقود المالية ومنع التعدي عليها وتحريم الإضرار بالمتعاقدين. *** Abstract: The principles of Islamic economics were keen on the stability of contracts, financial transactions and the preservation of rights between the contractors. The aim of this research was to explain a number of legislations that had a role in achieving contract stability, as well as a number of provisions and legislations that protect the rights of people and prevent harm to them. In this study, the researcher followed the inductive approach by following some relevant legal texts as well as the deductive approach to analyze these texts and provisions and clarify their role in contract stability and preserving rights. The study concluded that the system of legislation in the Islamic economy has included a number of legislations and provisions that worked to document rights and stability of financial contracts, prevent infringement of them, and prohibit harm to contractors.
