الملخص
الملخص: يعتمد نظام تمليك الشقق والطبقات على الشركة في ملكية العمارات المنقسمة، إلى طبقات أو شقق، أو محلات متعددة، بحيث يتملك شخصان فأكثر أجزاء في بناء واحد على وجه الملكية الخاصة، ويشتركون في ملكية الأجزاء الشائعة المخصصة للاستعمال المشترك، ونجد أن هذا النظام ليس حديث الولادة وإنما له جذور تاريخية في الفقه الإسلامي تحت مسمى نظام السفل والعلو، حيث نظمه الفقه الإسلامي وتناول أحكامه وإن كان على غير الصورة الموجودة اليوم، كما أن المشرع الجزائري في سبيل تنظيمه لملكية الشقق والطبقات باعتباره أهم الأنظمة في القضاء على مشكلة السكن قد مرَّ بعدة مراحل حتى وصل إلى المرسوم 83-666 المتعلق بتنظيم الأجزاء الخاصة والمشتركة، ونظم في تشريعاته أيضاً حقوق الملاك والتزاماتهم بالنسبة للأجزاء المفرزة فأعطاهم حق الاستعمال والاستغلال والتصرف للجزء الخاص بهم، ولم يبق هذا على الاطلاق وإنما قيده بعدة قيود تمنع الإضرار بالأخرين، من خلال إلزامهم بعدة واجبات تضمن استقرار البناء الموجودين فيه.
