الملخص
يعتبر عقد الامتياز القابل لتحويل الى تنازل من اجل انجاز مشاريع الترقية العقارية ذات الطابع التجاري الية اوجدها المشرع الجزائري ، من اجل دعم المرقي العقاري بأوعية عقارية من الأملاك الوطنية الخاصة من اجل انجاز مشروعه السكن ، و ذلك للمساهمة في القضاء على مشكل السكن في الجزائر ، و عقد الامتياز كسائر العقود يرتب اثارا على اطراف العقد ، لذلك نهدف من خلال دراستنا هذه أولا الى تحديد مفهوم هذا العقد و إجراءات ابرامه ، لنصل بعدها و بعد ان نحدد طبيعته الى معرفة مجموعة الاثار التي يرتبها على اطراف العقد ، فعقد الامتياز حقيقتا يرتب مجموعة من الحقوق لكلا من طرفي العقد في مواجهة الطرف الثاني ، يستفيد هذا الطرف من هذه الحقوق بناء على عقد الامتياز ، في المقابل فان لكل من طرفي العقد مجموعة من الالتزامات القانونية التي تقع على عاتقه يجب عليه تنفيذها لمصلحة الطرف الاخر في العقد. The concession contract, which can be converted into a waiver in order to complete commercial real estate promotion projects, is established by the Algerian legislator. As mechanism to support the real estate developers with a land base of national private property in order to complete his housing project, this contributes to the elimination of the problem of housing in Algeria. and the concession contract like all other contracts has an effect on the parties of the contract, So through this study we aim first to define the concept of this contract and the procedures for its conclusion And then, after we determine its nature, we know the set of effects that it has on the parties of the contract, The concession contract really entails a set of rights for both parties of the contract against the second party. The State Party shall avail itself of these rights on the basis of the concession contract; In return, each of the parties to the contract has a set of legal obligations that it has to perform in the other party's interest in the contract.
