دلالة المشترك وأثرها في الاختلاف الفقهي

الملخص
حاول هذا البحث الذي تناول دلالة المشترك وأثرها في الاختلاف الفقهي ضمن محاور ثلاثة، أن يحرر بعض المفاهيم الضرورية المتعلقة المشترك، الذي يعرفه الأصوليون بأنه: "اللفظة الموضوعة لحقيقتين مختلفتين أو أكثر، وضعا أولا، من حيث هما كذلك". حيث تناول البحث الخلاف في استعمال دلالة المشترك، هل تستعمل في جميع معانيها أم أنها لا تستعمل إلا في معنى واحد؛ حيث تبدو أهمية المشترك في البحث الأصولي وغيره من المباحث، فارتباط الاشتراك بالبحث اللغوي وأهميته في البحث الأصول إن دل على شيء فإنما يدل على أهمية اللغة لمن يتعاطى الفقه والأصول. وقد تناولت الدراسة بعض الاختلاف الفقهي في بعض الفروع الفقهية التي كان مصدر الاختلاف فيها الاختلاف في دلالة المشترك، فكان أن تناول نماذج من ذلك، فتناول الخلاف في دلالة لفظ "النكاح" والاختلاف دلالة لفظ "القرء" و"الطهر" وما ترتب عن ذلك من اختلاف فقهي. This research, which dealt with the significance of the common and its impact on the jurisprudential difference within three axes, tried to liberate some of the necessary concepts related to the common, which the fundamentalists define as: “The word formulated for two or more different facts, put first, in terms of what they are.” Where the research dealt with the controversy in the use of the connotation of the common, whether it is used in all its meanings or is it used only in one meaning; Where the importance of the participant appears in the fundamental research and other topics, the link of participation with linguistic research and its importance in the research of assets, if it indicates anything, then indicates the importance of language for those who deal with jurisprudence and principles. The study dealt with some doctrinal differences in some jurisprudential branches, in which the source of the difference was the difference in the connotation of the joint. Doctrinal difference.
