الشروط في النكاح "لا سابقة ولا لاحقة" نموذجا Conditions In Marriage "neither Precedent Nor Suffix" As An Example

الملخص

تناولنا في هذا البحث مسألة ادخار الشروط في النكاح، حيث كان ذلك التناول ضمن مبحثين تناولنا في الأول منها المفاهيم الرئيسة للموضوع وأحكام الاشتراط في النكاح في المذاهب الأربعة والظاهرية، وقد تناولنا في المبحث الثاني اشتراط "لا سابقة ولا لاحقة"، فتناولنا أوجه ذلك الاشتراط وحكم كل وجه منها. وقد توصلت الدراسة إلى أرجحية مذهب الجمهور في عدم لزوم الشروط في النكاح، وذلك وفقا لما قرره علماء المذاهب الثلاثة (الحنفية- المالكية الشافعية) والظاهرية الذين يرون عدم لزوم هذا الشروط وبطلانه، وقررت الدراسة ألا تناقض بين بطلان هذا الشرط ولزوم الوفاء بالعقود في الإسلام، ولا يلزم من إبطال اشتراط المرأة على الرجل ألا يتزوج عليها بطلان الشروط كلها في النكاح، بل إن الشروط منها مقبول مردود. In this research, we dealt with the issue of saving conditions in marriage, as this was dealt with within two sections, in the first of which we dealt with the main concepts of the subject and the provisions of stipulation in marriage in the four and zahir sects. every face of it. The study found the majority of the public school of thought in that the conditions are not necessary in marriage, according to what was decided by the scholars of the three schools (Hanafi, Maliki, Shafi’i) and Zahiriyya, who believe that these conditions are not necessary and invalid, and the study decided that there is no contradiction between the invalidity of this condition and the necessity of fulfilling contracts in Islam. The nullification of the woman’s condition that the man not marry her does not necessitate the nullification of all the conditions in the marriage, rather the conditions among them are acceptable and rejected.
