Abstract
يعد التراث الثقافي أحد الركائز الأساسية لهوية الشعوب ، فلكل أمة ثقافتها الخاصة من خلال ما تملكه من تراث يعبر عن تجذرها و عمق حضارتها، و أهمية التراث لا يمكن حصرها في أنه رافد من روافد هوية المجتمعات بل أصبحت له أهمية علمية و تاريخية و ثقافية وإقتصادية ، و أمام كل ما يمثله التراث من قيم حضارية للدول من جهة و ما يتعرض له من تعد و نهب من جهة أخرى خاصة أمام إنتشار جرائم الإعتداء على الأثار كان لا بد من حمايته و الحفاظ عليه و هذا هو الهدف المنشود من وراء هذا البحث، و من خلال ما توصلنا إليه في بحثنا هذا أن الآليات القانونية المرصودة لتوفير الحماية للتراث تظل قاصرة عن تحقيق هذه الغاية ، و بالتالي وجب دعمها و تفعيل الآليات الموجودة . Abstract: Cultural heritage is one of the basic pillars of the identity of peoples. Every nation has its own culture through what it possesses of heritage that expresses its rooting and the depth of its civilization. In view of all the cultural values that heritage represents for countries on the one hand, and the encroachment and looting on the other hand, especially in view of the spread of crimes against antiquities, it was necessary to protect and preserve it, and this is the desired goal behind this research, and from Through what we found in this research, the legal mechanisms designated to provide protection for heritage remain deficient in achieving this goal, and therefore it is necessary to support them and activate the existing mechanisms.
