انتقال الملكية العقارية بموجب المحررات التوثيقية في ضوء اجتهادات القضاء الجزائري

الملخص
الملخص: يعترض انتقال الملكية العقارية عدة إشكالات تتخلل النصوص التشريعية، ويهدف هذا العمل إلى بيان دور القضاء في إيجاد حلول لها من خلال الجمع بين مدلول هذه النصوص بدل إعمال المفاضلة بينها، ولم يعتبر القضاء الجنائي المحرر التوثيقي غير المشهر وثيقة عرفية. والراجح في مجال العلاقات التعاقدية أن انتقال الملكية العقارية بموجب المحرر التوثيقي يكون يوم شهر العقد بيد أنه يسري بأثر رجعي إلى زمن إبرامه، والحكم ذاته مقرر بالنسبة لانتقال الملكية بسبب الوفاة حيث تنتقل من تاريخ شهرها في البطاقات العقارية ويسري مفعولها بأثر رجعي إلى تاريخ الوفاة. وبتفحص أعمال القضاء في هذا الخصوص نجد تعارضا قائما بين مبادئه يستوجب العمل على إيجاد تقارب بين فحواها لبلوغ الغاية التي يبتغيها المشرع ألا وهي تعديل صياغة نصوص القانون بما يحقق الانسجام بين مقتضياته. Abstract: The transfer of real estate ownership opposes several problems which impregnate the legislative texts. This work aims to clarify the role of the judiciary by finding solutions to their by combining the meaning of these texts instead of implementing the comparison between their. The most correct in the field of the contractual relations is that the land transfers through notarial act is done on day of the publication of the act, but it’s take effect retroactively at the time of its conclusion.The same disposition as for the transmissions by death, because the property and the other rights in rem are transferred by the fact and from the day of publication to the real estate file and retroactively take effect on the date of the deathBy examining the work of the judiciary in this regard, we find an existing contradiction between its principles that necessitate efforts to find a convergence between their content in order to achieve the purpose sought by the legislator, which is to amend the formulation of the legal texts in order to achieve harmony between its requirements.
