الملخص
ملخص: تهدف هذه الدارسة إلى تبيان الجهود التشريعية التي بذلها المشرع الجزائري في إقرار النظام القانوني الخاص بالمسؤولية المدنية و الجزائية لمنتج النفايات و الحائز لها على ضوء إتفاقية بازل بشأن نقل النفايات الخطرة عبر الحدود و التخلص منها، في إطار تكريس الإقتصاد الدائري . من النتائج المتوصل إليها في هذه الدراسة، إكتفاء المشرع الجزائري بالإعتماد على القواعد العامة المتعلقة بالمسؤولية المدنية و الجزائية لمنتج النفايات فيما عدا تكريسه بعض الضمانات مثل إقرار صفة التقاضي للجمعيات البيئية و تكريس مسؤولية منتج النفايات على أساس الضمان، و هي ضمانات غير كافية لحماية حق المواطن في بيئة نظيفة أمام القضاء المدني و الجزائي. Abstract: This study aims to review the legislative efforts made by the Algerian legislator in approving the legal system for the civil and penal liability of the waste producer and holder of it in the light of the Basel Convention on the Transboundary Transport of Hazardous Waste and its Disposal, within the framework of the consolidation of the circular economy. Among the results reached in In this study, the Algerian legislator is satisfied with relying on the general rules related to the civil and penal liability of the waste producer, except for his devotion to some guarantees, such as approving the litigation status of environmental associations and devoting the responsibility of the waste producer on the basis of guarantees, which are insufficient guarantees to protect the citizen's right to a clean environment before the courts.
