دور الآلية الرقابية للمؤسسات الدولية في حماية الآثار

الملخص
تعتبر الآثار المادية وغير المادية ،العقارية والمنقولة الموجودة في مختلف دول العالم شواهدا حقيقية على قيام حضارات قديمة عرفت تقدما واضحا في كل المجالات تقريبا ،ونظرا للقيمة الهامة والإستثنائية لبعض الاثار ،أصبحت هذه الأخيرة محل نهب وسرقة وإعتداء من قبل معظم الدول المحتلة ،والكثير من الجماعات الإجرامية المنظمة العابرة للحدود ،و لذلك يهدف هذا البحث إلى معاينة الأسباب التي ساهمت في زيادة وتفشي هذه الجرائم الأثرية كتعدد النزاعات المسلحة الداخلية والخارجية ،وإنتشار الأنترنت في معظم الدول وقد توصلنا في نهاية هذه الورقة البحثية إلى ضرورة تكثيف جهود وتدخلات هيئات المجتمع الدولي التي يجب أن تمارس دورها التشريعي والتنفيذي في مجال الرقابة لحماية هذه الآثار وصيانتها بكل شدة وحزم وشفافية واسعة ومصداقية كبيرة ،وهذا بالرغم من تعدد العوائق، كما أن تعزيز التعاون الدولي في هذا الشأن قد أصبح واجبا وإلتزاما ملقى على كل دول العالم وهذا من أجل الحفاظ على الموروث الثقافي الذي يهم البشرية جمعاء. Abstract : The tangible and non-material, real estate and movable antiquities found in various countries of the world are real evidence of the emergence of ancient civilizations that knew clear progress in almost all fields, and due to the important and exceptional value of some antiquities, the latter became the subject of looting, theft and assault by most of the occupied countries, and many groups transnational organized crime. Therefore, this research aims to examine the reasons that contributed to the increase and spread of these archaeological crimes, such as the multiplicity of internal and external armed conflicts, and the spread of the Internet in most countries. The field of oversight to protect and preserve these antiquities with full intensity, firmness, wide transparency and great credibility, and this is despite the multiplicity of obstacles, and the strengthening of international cooperation in this regard has become a duty and obligation placed on all countries of the world and this is in order to preserve the cultural heritage that concerns all mankind.
