الملخص
يلعب مبدأ المنافسة الحرة دورا هام في المجال الاقتصادي عن طريق زيادة الفعالية للمتعاملين الاقتصاديين الذين يترك لهم حرية التنافس بينهم في إطار حرية التجارة و الصناعة، و باعتبار الصفقات العمومية أحد المواضيع المهمة في المجال الاقتصادي لتعلقها بالمال العام وكونها من بين أهم ميادين تنافس هؤلاء المتعاملين الاقتصاديين، كان لابد على المشرع الجزائري من إعمال مبدأ المنافسة الحرة في مجال الصفقات العمومية ومن ثمة إلزام المتعامل الاقتصادي باحترام مبدأ حرية المنافسة و مراعاته خلال جميع مراحل إبرام الصفقة العمومية، لذلك تطرقنا في هذا البحث إلى الإجابة عن كيفية إعمال مبدأ المنافسة في مجال الصفقات العمومية من خلال استعمالنا لمنهج التحليل لنصوص قانون الصفقات العمومية. The important role That the principole of free competition plays in the economic field by increasing the effectiveness of economic dealers by leaving freedom of competition between them in the context of freedom of trade and industry, Also that considering Public procurements as one of the important topics in the economic field Because itattached to public money and beingamong the most important fields of competition for these economic dealers, The Algerian legislator had to implement the principle of free competition in the field of Public procurements, Hence, obliging the economic operator to respect the principle of freedom of competition and observetit during all stages of the conclusion of the Public. Le role important que joue le principe de libre concurrence dans le domaine économique en augmentant l'efficacité des distributeurs économiques, Ceux qui sont laissés libres de rivaliser avec euxdans le contexte de la liberté du commerce et de l'industrie, Et considérer les marchés publics comme l'un des sujets importants dans le domaine économique, car ils concernent l'argent public et font partie des domaines de concurrence les plus importants pour ce sopérateurs économiques. Le législateur algérien a dûmettre en œuvre le principe de libre concurrence dans le domaine des marchés publics, Par conséquent, le client économique a l'obligation de respecter le Principe de la liberté de concurrence et de le respecter pendant toutes les phases de la conclusion de l'accordgénéral, Par conséquent, nous avons discuté dans cette recherche de la réponse au fonctionnement du principe de concurrence dans le domaine des marchés publics, Grâce à notre utilisation de la method d'analyse des dispositions du droit des marchés publics.
