الملخص
يطبق قانون المنافسة على نشاطات الإنتاج والتوزيع والخدمات بما فيها تلك التي يقوم بها الأشخاص العموميون إذا كانت لا تندرج ضمن إطار الممارسة صلاحيات السلطة العامة أو أداء مهام المرفق العام"، وعليه يكون النشاط الاقتصادي الصرف سواء الإنتاجي أو التوزيعي أو الخدمي هو العبرة عند تحديد مجال إعمال قانون المنافسة، بغض النظر عن طبيعة العون الاقتصادي الممارس لهذا النشاط من حيث كونه شخصا خاصا أو عاما. فيما عدا الحالات التي يتدخل فيها هذا الأخير باعتباره سلطة عامة حسب ما يتضح في قانون الصفقات العمومية في الكثير من الأحكام، كالامتيازات الممنوحة للمنتج الجزائري على حساب المنتجات الأجنبية أو الشركات الجزائرية على حساب الشركات الأجنبية، وكذلك الأمر بالنسبة للاستثناءات المقررة قانونا لمصلحة دعم أسعار السلع للمنتجات واسعة الاستهلاك أو التدابير المتضمنة تحديد هوامش الربح للسلع التي تعرف ارتفاعا مفرطا و غير مبرر لأسعاره، لذا أدخل قانون المنافسة في مجال التطبيق الصفقات العمومية وأصبحت مشمولة بأحكام قانون المنافسة. The competition law applies to production, distribution and services activities, including those carried out by public persons, if they do not fall within the framework of exercising the powers of a public authority or performing the tasks of a public utility. Competition law, regardless of the nature of the economic aid practicing this activity in terms of whether it is a private or public person. Except for cases in which the latter interferes as a public authority, as is evident in the law of public procurement in many provisions, such as the privileges granted to the Algerian product at the expense of foreign products or Algerian companies at the expense of foreign companies, and the same applies to the exceptions established by law in the interest of supporting commodity prices Excessive and unjustified price hikes are required for products with extensive consumption or the measures included in determining profit margins for goods whose prices are excessive and unjustified. Therefore, the competition law has introduced public deals into the field of application and has become covered by the provisions of the competition law.
