التحفظ الدولي على اتفاقيات حقوق الإنسان

الملخص
تشهد الساحة الدولية اهتماما متزايدا بحقوق الإنسان على اعتبار أن هذا الأخير هو غاية كل من التنظيم الداخلي والدولي، وبعدما أظهرت إجراءات حماية حقوق الإنسان عدم كفايتها في النطاق الداخلي للدولة بدأ البحث عن حمايتها على الصعيد الدولي من خلال المعاهدات الدولية التي تبرمها الدول، مما يرتب التزامات وقيود على سلطات الدولة، ولأن الدول غالبا ما تقوم بتغليب مصالحها الداخلية على أن تلتزم بمعاهدة لا يمكن الاتفاق على بنودها، لذا كان التحفظ هو المخرج لتفادي الانقسام الدولي والوصول إلى توافق دولي، حيث يمكن للدولة اللجوء إلى التحفظ عندما تتعارض بعض بنود هذه المعاهدات مع مصالحها. ولا شك أن هذه الحالة أفضل من استبعاد الدولة المتحفظة على اتفاقية دولية لحقوق الإنسان أو عدم مشاركتها فيها، وبالنظر لخصوصية تلك الاتفاقيات فقد أنشأت هذه الأخيرة أجهزة تختص بالبت في صحة التحفظات التي تبديها الدول على أحكام هذه الاتفاقيات. The international arena is witnessing an increasing interest in human rights, given that the latter is the goal of both internal and international regulation, and after the measures for the protection of human rights showed their inadequacy within the internal sphere of the state, the search for their protection began at the international level through international treaties concluded by states, which entails obligations and restrictions on the powers of the state, and because states often give priority to their internal interests to be bound by a treaty whose terms cannot be agreed upon, so reservation was the way out to avoid international division and reach international consensus, where the state can resort to reservation when some of the provisions of these treaties conflict with its interests . Undoubtedly, this situation is better than excluding the reserving state or not participating in an international convention on human rights, and given the specificity of those conventions, the latter has established bodies specialized in deciding on the validity of reservations made by States to the provisions of these conventions.
