استثمار الأموال الوقفية وضوابطه الشرعية

الملخص
ملخص: يركز البحث على كشف الضوابط الشرعية العامة والخاصة لاستثمار الأموال الوقفية، بما يحقق أهداف الدراسة من: المحافظة على أصل الوقف من الاندثار فتركه بلا استثمار تقضي عليه النّفقات والمصاريف، إلى المساهمة في تحقيق أهداف الوقف الاجتماعيّة والاقتصاديّة والتّعليميّة والتّنمويّة، وأخيراً الحصول على أكبر عائد للوقف وتأمين أعلى ربح أو ريع من الأصل. ومن أهمّ نتائج هذه الدراسة: ضرورة استثمار الأموال الوقفيّة عموماً وفائض غلّتها خصوصاً محافظة على مقدّرات المجتمع والأمّة، وسدّ حاجاتها الواقعة والمتوقّعة لكلّ الأجيال المتعاقبة، وجوب مراعاة الضوابط الشرعيّة العامّة والخاصّة التي تحكم عمليّة استثمار الأموال الوقفيّة، ضرورة الاستعانة بأساليب الإدارة الماليّة الحديثة، وأساليب تكنولوجيا صناعة المعلومات، وشبكات الاتّصالات الآليّة المعاصرة في إدارة أموال المؤسسّات الوقفيّة. Abstract: This research focuses on revealing the general and special legal rules for investing Endowment funds, in order to achieve the objectives of this study, from: preserving the Endowment origin from extinction, leaving it without investment, which is eliminated by Outlay and expenses, to contributing to achieving the Endowment’s social, economic, educational and development goals, and finally obtaining the largest return Endowment and securing the highest profit or proceeds from the asset. The most important results of this study are: The necessity of investing Endowment funds in general and their surplus yields in particular, in order to preserve the capabilities of society and the nation and meet its actual and expected needs for all successive generations. The necessity of observing the general and specific Shari’ah rules that govern the process of investing Endowment funds. The need to use modern financial management methods, information technology methods and contemporary automated communication in managing the funds of Endowment institutions.
