الحماية القانونية للصفقات العمومية الإلكترونية بالجزائر Legal Protection Of Electronic Public Procument In Algeria

الملخص
جسّد المشرع الجزائري رقمنة الصفقات العمومية تحقيقا للشفافية ، و المساواة ، وتنافسية أكبر للصفقات العمومية من خلال المرسوم الرئاسي 10-236 المتعلق بتنظيم الصفقات العمومية ، و تلاه إصدار القرار المؤرخ في 17 أفريل 2013 الذي انشا بموجبه البوابة الإلكترونية للصفقات العمومية ، ليؤكد على هذا التوجه من خلال المرسوم الرئاسي 15-247 المتضمن لقانون الصفقات العمومية و تفويضات المرفق العام ، مما ألزم المشرع الجزائري مرافقة هذا التحول الرقمي بتوفير الحماية القانونية و التقنية اللازمة للنظام المعلوماتي الخاص بالصفقات العمومية الإلكترونية من جميع مظاهر الجريمة الإلكترونية خاصة ، وذلك بإتخاذ العديد من الإجراءات الوقائية كالتوقيع و التصديق الإلكترونيين ، نظام الأرشفة الإلكترونية ،و معالجة المعطيات الشخصية ، ... الخ ، و أخرى ردعية أهمها قانون 09-04 المتضمن القواعد الخاصة للوقاية من الجرائم المتصلة بتكنولوجيات الإعلام و الإتصال و مكافحتها ، قانون العقوبات ، و قانون الإجراءات الجزائية الجزائري بتوقيع أقسى العقوبات ، و بالتالي حماية المال العام من مظاهر الفساد. The digital transformation of the Algerian economy and public administration obliges the Algerian legislator to review the laws and the rules of public procurement like the Presidential Decree 10-236 related to the organization of public procurement, followed by the issuance of the decision dated April 17, 2013, in which he established the electronic portal for public procurement, to confirm this trend Through Presidential Decree 15-247 containing the Public Procurement Law and Public Facility Authorizations , Which obligated the Algerian legislator to accompany this digital transformation by providing the necessary legal and technical protection for the information system of electronic public procurement from all aspects of electronic crime in particular , by taking many preventive measures such as electronic signature , electronic archiving system , and processing personal data , …Etc, and other deterrents , the most important of which are Law 09-04 , which includes special rules . So, The Algerian legislator aims at facing new challenges of digital revolution for the upcoming years to rethink a new legal framework to consider the new rules with technical constraints required by a digital world.
