إعادة التنظيم المالي للمشروعات المتعثرة كوسيلة للحدّ من إفلاسها في ضوء نظام الإفلاس السعودي

الملخص
يعتبر تعثر المشروعات من أخطر الطرق المؤدّية إلى تصفية المشروعات التجارية وانتهائها، والتي تزداد أكثر في ظل سوء إدارة المشروعات وجمودها، وحدوث الأزمات والظروف الخارجية التي تؤثر في قدرة المشروعات على مواجهتها. ويُعدُّ إعادة التنظيم المالي للمشروعات المتعثرة من أهمّ الوسائل التي أقرّها المُنظم السعودي لمواجهة اضطراب المشروعات وتعثرها، ووضع الحلول للحدّ من إفلاسها وتصفيتها. فهو إجراء قضائي وقائي يهدف إلى التوصل إلى اتفاق بين المدين ودائنيه لحل ما طرأ على المشروع من اضطراب أو تعثر من شأنه التأثير على التزاماته تجاه الآخرين. لذا فإعادة التنظيم المالي وقاية وإنقاذ للمشروع، ونجاح هذا الإنقاذ مرتبط بمدى تعاون المدين وجديته في التخلص من الاضطراب والتعثر. Abstract: Project faltering is considered one of the most dangerous ways leading to the liquidation and termination of commercial projects, which increases under mismanagement and stagnation of the projects, and the occurrence of crises and external circumstances that affect the ability of projects to confront them. The financial reorganization of faltering business projects is one of the most important means approved by the Saudi regulator to confront the disruption and faltering of projects, and to develop solutions to limit their bankruptcy and liquidation. It is a judicial and preventive procedure that aims to reach an agreement between the debtor and his creditors to resolve any turmoil or faltering in the project that may affect his obligations towards others. Therefore, financial reorganization is a prevention and rescue for the project, and the success of this rescue is linked to the extent of the debtor’s cooperation and seriousness in getting rid of the turmoil and stumbling.
