نظام الخسائر البحرية المشتركة مابين الذاتية والضرورة

الملخص
ملخص تهدف هذه الدراسة إلى إبراز ذاتية نظام الخسائر البحرية المشتركة وطابعه الاستثنائي، نظرا لتعلقه ببيئة لا تكاد تخلو من المخاطر. كما نصبو من خلالها إلى إظهار مدى أهمية هذا النظام وضرورته في التجارة البحرية الحديثة حتى وإن تزامن مع نظام آخر ألا وهو نظام التأمين. ومن هذا المنطلق ومن خلال تحليلنا لمختلف الجوانب المتعلقة بنظام الخسائر البحرية المشتركة خلصنا إلى أنه رغم أنه نظام معقد بعض الشيء إلا أن هذا لا يعد كافيا للقول بإلغائه لصالح نظام التأمين، كون هذا الأخير لا يمتد لتغطية كل الخسائر كما هو الشأن بالنسبة لخسائر النفقات، مما يرجح كفة نظام الخسائر البحرية المشتركة ويجعل منه أكثر فاعلية ولا يمكن الاستغناء عنه في أي حال من الأحوال. Abstract : This study aims to highlight the subjectivity and exceptional nature of the system of shared marine losses, as it relates to an environment that is almost risk-free. Through it, we also aim to show the importance and necessity of this system in modern maritime trade, even if it coincides with another system, which is the insurance system. In this sense, and through our analysis of the various aspects related to the system of common maritime losses, we concluded that although it is a somewhat complex system, this is not enough to say that it is cancelled in favour of the insurance system, as the latter does not extend to cover all losses as is the case with loss of expenses, which out the system of common maritime losses and makes it more effective and indispensable in any way.
