تحديد مسؤولية المقاول الفردي: دراسة مقارنة بين التشريعين الجزائري والفرنسي

الملخص
لتحديد مسؤولية المقاول الفردي، كرّس المشرعين الفرنسي والجزائري، في القانون التجاري، آليات قانونية، تتمثل الأولى في نظام "المؤسسة ذات الشخص الوحيد وذات المسؤولية المحدودة"EURL، وتتمثل الثانية في نظام "المقاول الفردي ذو المسؤولية المحدودة"EIRL فالآلية الأولى معروفة في القانون الجزائري منذ صدور الأمر رقم 96 -27، وفي القانون الفرنسي عُرفت منذ صدور تشريع 85 – 697، والآلية الثانية كرسها فقط المشرع الفرنسي بموجب تشريع 2010 -658، غير أن فكرة تحديد المسؤولية فكرة نسبية، بحيث أثبتت الدراسة أن المقاول الفردي غالبا ما يكون مسؤولا مسؤولية مطلقة، في حالات معينة، في ظل النظامين السالفي الذكر.
