الملخص
ملخص: الإغراق التجاري ظاهرة ذات أبعاد خطيرة على اقتصاد أي دولة، لذلك سعى المشرع الجزائري إلى مواجهته من خلال تكريس ما يعرف بالحق ضد الإغراق تأسيسا على ما تضمنه اتفاق مكافحة الإغراق الجات 1994 من اجراءات و تدابير مناسبة لمكافحة الإغراق و آثار الأضرار التي يسببها, و منه تستهدف الدراسة تبيان الأحكام المتعلقة بالحق ضد الإغراق انطلاقا من تحديد إطاره المفاهيمي ووصولا إلى الآليات المنصوص عليها في إطار تطبيق هذا الحق. كلمات مفتاحية: إغراق تجاري. إتفاق مكافحة الإغراق. إغراق. الحق ضد الإغراق. Abstract: Commercial dumping is a phenomenon with serious dimensions on the economy of any country, therefore the Algerian legislator sought to confront it through the establishment of the right anti- dumping, based on the provisions of the anti-dumping agreement GATT 1994 in terms of appropriate measures and measures to combat dumping and the effects of the damage it causes. The purpose of the study is to clarify the provisions relating to the right anti dumping, based on the definition of its conceptual framework and the mechanisms provided for in the application of this right.
