الوسائل القانونية لتدخل السلطة التنفيذية في العمل التشريعي في النظام لسياسي الجزائري في الحالات العادية من خلال دستور 2020

الملخص
يعتبر التشريعُ الاختصاصَ الأول للبرلمان, لكن لا يعني أن هذا الأخير يمارس هذه السلطة بعيدا عن رئيس الجمهورية, بل إن هناك وسائل قانونية تعطي له كل الضمانات للتدخل في العمل التشريعي ويشارك السلطة التشريعية في كل مراحل سن القوانين ما عدا التصويت فقط، وفي بعض الحالات يشرع رئيس الجمهورية مكان البرلمان (إثناء عطلة البرلمان، وفي غيبته). وهذا ما يؤكد المكانة الدستورية والسياسية التي يتمتع بها رئيس الجمهورية في النظام السياسي الجزائري على حساب كل المؤسسات الدستورية الأخرى, وكذلك كيفية قيام العلاقة بين السلطات والتي تغلب دائما كفة السلطة التنفيذية على حساب السلطتين التشريعية والقضائية, على الرغم من أن كل دساتير الجزائر في مرحلة التعددية الحزبية تضمنت مبدأ الفصل بالسلطات وخصصت له مواد دستورية. Legislation is the first competence of Parliament, but this does not mean that Parliament exercises this power away from the President of the Republic. Rather, there are legal means that give it all guarantees to interfere in the legislative work. The legislative authority participates in all stages of the enactment of laws with the exception of voting only, and in some cases The President of the Republic legislates the place of Parliament (during the parliament’s recess and in its absence), and this confirms the constitutional and political status that the President of the Republic enjoys in the Algerian political system at the expense of all other constitutional institutions, as well as how the relationship between the authorities, which always prevails over the power, is established. The executive branch at the expense of the legislative and judicial authorities, although all the constitutions of Algeria in the multi-party stage incorporated the principle of separation of powers and assigned constitutional articles to it.
