علاقة رئيس الجمهورية بالوزير الاول من خلال التعديل الدستوري 2020

الملخص

منذ اقرار مبدأ ثنائية السلطة التنفيذية في الجزائر سنة 1988 على اثر تعديل دستور 1976 الى غاية اخر تعديل دستوري سنة 2020 لم نلاحظ في كل الدساتير السابقة (1989- 1996- 2016) سوى تقوية مكانة رئيس الجمهورية سياسيا ودستوريا على حساب الوزير الاول ,وهذا ما أخل بمبدأ ثنائية السلطة التنفيذية وجعلها شكلية فقط ,اما الوزير الاول وجهاز حكومته ككل هم عبارة عن جهاز تنفيذي لبرنامج رئيس الجمهورية والمسؤول سياسيا امام البرلمان عن تنفيذ السياسة العامة وبرنامج رئيس الجمهورية ,لذلك فالوزير الاول لايزال تابعا لرئيس الجمهورية من ناحية العضوية من حيث التعيين والتنحي، ومن الناحية الوظيفة بحيث كل صلاحياته يستمدها من رئيس الجمهورية حتي الصلاحيات التي خولها له دستور2020 صراحة في المادة 112. Since the adoption of the principle of dual executive power in Algeria in 1988 following the amendment of the 1976 constitution until the last constitution amendment in 2020, we have not noticed in all previous constitution ( 1989 – 1996-2016) anything but the strengthening of the president of the republic’s political and constitutional position at the expense of the prime minister, and this has violated the principle of dualism the executive authority and make it only formal. As for the prime minister and his government apparatus as a whole, they are an executive body for the program of the president of the republic and who is politically responsible before parliament for implementing the general policy and the program of the president of the republic. Therefore, the prime minister is still subordinate to the president of the republic in terms of membership in terms of appointment and stepping down, and functional so that he derives all his powers from the president of the republic, even the powers that the 2020 constitution explicitly delegates to him in article 112.
