صلاحيات السلطة التنفيذية في الحالات غير العادية في النظام السياسي الجزائري The Powers Of The Executive Branch In Unusual Cases In The Algerian Political System

الملخص
خوّلت السلطة التنفيذية سلطات واسعة في الحالات غير عادية من خلال التعديل الدستوري 2020 عن طريق رئيسها الممثل في شخص رئيس الجمهورية، والذي يمنحه الدستور الحق في تجاوز صلاحياته وممارسة صلاحيات المؤسسات الدستورية الأخرى مثل البرلمان والحكومة، وذلك لمواجهة الظروف التي ادت الى اعلان احدى الحالات المذكورة في الدستور والتي تتفاوت خطورتها من حالتي الطوارئ والحصار الى الحالة الاستثنائية الى حالة الحرب، والتي تعتبر اخطر حالة اين يتوقف العمل بالدستور وتتوقف كل المؤسسات السياسية عن اداء وظائفها وينتظر ما يقرره رئيس الجمهورية. The executive authority has granted broad powers in extraordinary cases through the constitutional amendment 2020 through its president represented in the person of the president of the republic , which the constitution gives him the right to override his powers and exercise the powers of other constitutional institutions such as parliament and the government in order to meet the circumstances that led to the announcement of one of the cases mentioned in the constitution the severity of which varies from states of emergency and siege to the exceptional state to the state of war, which is considered the most dangerous situation where the work of the constitution stops and all political institutions stop performing their functions and awaits the decision of the president of the republic. Le pouvoir exécutif a accordé de larges pouvoirs dans des cas extraordinaires à travers l'amendement constitutionnel 2020 à travers son président représenté en la personne du président de la république, que la constitution lui donne le droit d'outrepasser ses pouvoirs et d'exercer les pouvoirs d'autres institutions constitutionnelles telles que parlement et le gouvernement afin de faire face aux circonstances qui ont conduit à l'annonce d'un des cas mentionnés dans la constitution dont la gravité varie de l'état d'urgence et de siège à l'état d'exception jusqu'à l'état de guerre, considéré comme le plus situation dangereuse où le travail de la constitution s'arrête et toutes les institutions politiques cessent d'exercer leurs fonctions et attendent la décision du président de la république.
