الملخص
ملخص : تعد الجرائم البيئية من بين أهم التحديات التي تهتم بها الدول والمنظمات الدولية من أجل الوقاية منها ومكافحتها، خاصة مع تطور هذه الجرائم التي أصبحت تتسم بالطابع مما زاد من خطورتها من جهة، وصعب من توقيع الجزاء على مرتكبيها في ظل غياب محكمة جنائية دولية مختصة في الجرائم البيئية من جهة أخرى، مما دفعنا إلى البحث في إمكانية انعقاد اختصاص المحكمة الجنائية الدولية للنظر في الجرائم البيئية عند تكييفها كجريمة حرب أو جريمة ضد الإنسانية مثلما هو منصوص عليه في نظامها الأساسي، حتى لا يكون هناك إفلات من العقاب وتحقيق العدالة الجنائية. Abstract: Environmental crimes are among the most important challenges that countries and international organizations are concerned with to prevent and combat them, especially with the development of these crimes, which have been characterized by a character that increased their gravity on the one side, and it was difficult to sentence the perpetrators in the absence of an international criminal court specialized in environmental crimes. On the other side, which prompted us to discuss the possibility of summoning the jurisdiction of the International Criminal Court to examine environmental crimes when they are adapted as a war crime or a crime against humanity, as stipulated in its statute , so that there is no impunity and that criminal justice is achieved.
