الملخص
تزايد إهتمام أعضاء المجتمع الدولي بمسألة حماية البيئة الطبيعة من الأضرار التي قد تلحق بها منذ نهاية الحرب العالمية الثانية، و ما أفضت عنه النزاعات المسلحة عبر العالم من خسائرَ لم تقتصر على الأعيان العسكرية أو المدنية فحسب، و إنما شملت بحكم إتساع نطاق الأسلحة المستخدمة في إطارها البيئة الطبيعية في مختلف أشكالها. و على الرغم من المبادرات التي أقدم عليها أعضاء المجتمع الدولي، إلا أن هذا النوع من الممارسات لم تكن موضوع تجريم، أو حتى تكييف قانوني في نص أي إتفاقية أو معاهدة دولية، بما عقّد مهمة التصدي لهذا النوع من الشذوذ. تهدف الدراسة الراهنة إلى تسليط الضوء على الخلاف السائد حول التكييف القانوني للانتهاكات الماسة بالبيئة الطبيعية، على أن تتمحور أهم النتائج المتوصل إليها حول إفتقار المنظومة القانونية السارية المفعول على الصعيد الدولي إلى أداة تشريعية تتناول هذه المسألة بالدراسة في أدق ثناياها. The increasing interest of members of the international community in the issue of protecting the natural environment from the damage that may be inflicted on it since the end of the Second World War, and the losses that armed conflicts around the world have resulted in, not limited to military or civilian objects only, but also included due to the wide range of weapons used in it encompasses the natural environment in its various forms. Despite the initiatives undertaken by members of the international community, this type of practice has not been the subject of criminalization, or even legal characterization in the text of any international agreement or treaty, which complicates the task of addressing this type of anomaly. The current study aims to shed light on the prevailing disagreement about the legal characterization of violations of the natural environment, with the most important findings centered on the lack of the legal system in force at the international level to a legislative tool that deals with this issue by studying in its most accurate folds.
