المسئولية المدنية عن المساس بالبيئة الطبيعية أمام القضاء Civil Responsibility For Harming The Natural Environment Before The Judiciary

الملخص

إن البيئة ذلك الوسط الحي الذي يعيش فيه الإنسان و تستمد منه جميع الكائنات الحية منبع الحياة، يتعرض حديثا لتدهور مستمر إثر سوء تصرف الإنسان و اعتداءاته العمدية و الغير العمدية المتفاقمة عليها. فأصبحت قضية البيئة و حمايتها من الأمور الجد هامّة على الصعيد الوطني و الدولي لإرتباطها الوثيق بحياة الإنسان و الكائنات الحية. لذلك توجهت جلّ التشريعات العمل على حماية االبيئة و ظهر دور القضاء الفعال كآلية لصيانتها من خلال إقرار المسؤولية المدنية عن المساس بالبيئة. لذا نطرح الإشكالية التالية : ماهية المسؤولية المدنية عن المساس بالبيئة الطبيعية أمام القضاء من خلال الخطة الموالية : المبحث الأول : أساس المسئولية المدنية عن الأضرار البيئية . المطلب الأول : نظرية الخطئ المطلب الثاني : الأسس الحديثة . المبحث الثاني : جزاء المسؤولية المدنية عن الأضرار البيئية مطلب الأول : إجراءات دعوى التعويض. المطلب الثاني : التعويض المترتب عنه The environment, the living environment in wich man lives and derives from him, all living beings from the source of life is newly subjected to continuous deterioration due to human misconduct and intentional and inatentional attacks on them. The issue of the environment and its protection has become very important at the national and international levels because of its close connection with human and living life. Most of the legislation aimed at protecting the environment and the role of effective judiciary as a mechanism for it’s maintenance through the establishment of civil responsibility for harm the environment. So we raise the following problem of what is the civil responsibility for the damage to the national environment before the judiciary through the plan is loyal: The first topic: the basis of civil liability for environmental damage The first requirement: theory of error The second requirement: the modern foundations The second topic: the penality of civil liability for environmental damage The first requirement: the procedures for compensation The second requirement: compensation resulting
