Addressing The Phenomenon Of Illegal Immigration In International Agreements التصدي لظاهرة الهجرة غير الشرعية في الإتفاقيات الدولية

الملخص

أدى إنتفاض الشعوب في الدول العربية إبتداء من سنة 2011 ضد حكامهم نتيجة تدهور الظروف الإجتماعية، والإقتصادية، والسياسية إلى فرار عدد معتبر من الأفراد الذين ينتمون إلى هذه الدول نتيجة القمع العسكري الذي ردت به هذه السلطات على هذا النوع من الحركية، وإتجه أغلبهم نحو الدول الأوربية التي كانت تشكل في نظرهم ملاذا آمنا يمكن لهم في إطاره توفير الأمن والإستقرار لأفراد أسرهم. حملت موجة الهجرة غير المعهودة التي شهدتها القارة الأوروبية خلال السنوات الأخيرة مخاطر متعددة تتعلق بأمن الأوروبين وإستقرارهم الإقتصادي بالدرجة الأولى، وهو الأمر الذي دفع بأعضاء المجتمع الدولي إلى تكثيف جهودهم من أجل التصدي لهذه الظاهرة، ولا سيما على الصعيد التشريعي، حيث تعددت النصوص القانونية المتبناة في هذا الصدد من أجل حصر هذه الظاهرة في أضيق الحدود، لعل أبرزها إتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية، و برتوكول مكافحة تهريب المهاجرين عن طريق البر والبحر والجو لسنة 2000. The uprising of peoples in the Arab countries, starting in 2011, against their rulers, as a result of the deteriorating social, economic, and political conditions, led to the flight of a significant number of individuals belonging to these countries as a result of the military repression with which these authorities responded to this type of movement, and most of them headed towards European countries. Which, in their view, constituted a safe haven within which they could provide security and stability for their family members. The unusual wave of immigration that the European continent has witnessed in recent years has posed multiple risks related to the security and economic stability of Europeans in the first place, which has prompted members of the international community to intensify their efforts to address this phenomenon, especially at the legislative level. In this regard, in order to limit this phenomenon in the narrowest limits, perhaps the most prominent of them is the United Nations Convention against Transnational Organized Crime, and the Protocol against the Smuggling of Migrants by Land, Sea and Air of 2000.
