الملخص
يتناول المقال بالبحث والاستقراء الأحكام الفقهية والقانونية التي ترد على الطلاق في مرض الموت، حيث خلصت إلى أنّ فقهاء الشريعة والقضاء الجزائري، قد أقرّوا بالإرث للزوجة في حال الطلاق، وأقرّوا أيضا بجواز خلع المرأة المريضة لزوجها، بقدر ميراثه منها أو أقل، كما يجوز خلعها منه وهو مريض، مع الإشارة إلى وباء (كوفيد 19) وتكييفه الفقهي..The following article sheds the lights on the legal provisions of the algerian législature as well s thé jurisprudence concerning the divorce in the case of death.Both have recognized the inheritance of the wife in the event of divorce, ad the permissibility of the sick woman to divorce her husband, as much or less as his inheritance from her.It is also permissible to remove her from him in case of husband's sickness. The challenge is to consider the ongoing epidemy (Covid 19) as a legal motive for divorce
