الملخص
تم النص على لجنة فتح الأظرفة وتقييم العروض ضمن أليات الرقابة القبلية على الصفقات العمومية، كما تم النص على أنها تقوم بعمل إداري وتقني تعرضه على المصلحة المتعاقدة، لتقرر الأخيرة بشأنه ما تراه مناسبا. وبعد استعراض جانب من الأحكام القانونية المرتبطة بعمل ودور هذه اللجان، يتبين أنه من الضروري إعادة النظر في تنظيم طريقة عملها وفي تكوينها وعضويتها خاصة على مستوى الجماعات الاقليمية، وكذلك في ضرورة التحديد الكافي لشروط ومؤهلات أعضائها وضرورة اتباعها لنظام داخلي يحدد كيفية ونصاب صحة اجتماعاتها، ويضمن قدر من الاستقلالية في آداء مهامها طالما توصف بأنها هيئة من هيئات الرقابة الداخلية. Abstract: The committee for opening envelopes and evaluating offers was stipulated within the tribal control mechanisms over public deals, and it was also stipulated that it performs an administrative and technical work that it presents to the contracting authority, for the latter to decide on it what it deems appropriate. After reviewing some of the legal provisions related to the work and role of these committees, it turns out that it is necessary to reconsider the organization of their modus operandi, their composition and membership, especially at the level of regional groups, as well as the necessity of adequately defining the conditions and qualifications of their members and the need to follow an internal system that determines the manner and quorum of the validity of their meetings.
