الملخص
ملخص : أصبحت حوكمة إبرام الصفقات العمومية مطلبا اقتصاديا واجتماعيا للارتقاء بمنظومتها القانونية إلى مستوى أفضل من النجاعة والفاعلية في الطلب العمومي وحسن استعمال المال العام، بيد أنّه، لا مجال للحديث عن هذه " الحوكمة " ما لم يتوفر نظام فعّال يضمن شرعية القانون ويجسد الشفافية والنزاهة والمساواة والمشاركة ويحدد سلطات ومسؤوليات جميع الأطراف المتدخلة في هذا الإبرام. من بين أبرز الأطراف الفاعلة في إبرام الصفقات العمومية هي"لجنة فتح الأظرفة وتقييم العروض" التي لها تأثير مباشر على اختيار المتعامل المتعاقد الذي سيضمن التنفيذ الحسن للصفقة نوعياً ومالياً، وعليه، يسلط هذا المقال الضوء على الدور الذي تضطلع به هذه اللجنة في تحقيق حوكمةٍ جيدة لإبرام الصفقات العمومية. Abstract: The governance of concluding public procurements has become an economic and social imperative in favour of raising the entire structure of its legal system to a higher level of transparency with a view to achieving more effective and efficient level in the public demand as well as improving the public funding mechanisms. However, there is no scope for any discussion of ‘governance’ as defined, unless there is an effective system, which provides assurances of legitimacy, transparency, integrity, equality and participation through better delineation of duties and responsibilities of all parties involved. Among the most notable parties engaged in concluding public procurements is ‘Committee of opening envelopes and evaluation of the offers’, which has an immediate bearing on the selection of the contractor, who will ensure the proper implementation of the procurement qualitatively and financially. The aim of this paper is thus, to highlight the role of the Committee of opening envelopes and evaluation of the offers as a key actor in the good and inclusive governance of concluding public procurements.
