حق الزوجة في رفض أو قبول تعدد الزوجات وأثره على استمرار الحياة الزوجية Wife’s Right To Refuse Or Accept Polygamy And Its Effect On Marital Life Continuation

الملخص
يعدّ نظام تعدد الزوجات نظام اجتماعي قديم أباحته مختلف الشرائع ومارسته مختلف الشعوب قبل الإسلام دون قيد أو شرط،لكن بمجيء الإسلام أقرّه وأباحه تحت شروط فقيّد عدد الزوجات بأربع وإقامة العدل بينهن بغرض وضع حد للظلم والتقصير في الحقوق،يتضح هذا التقييد في أنّه لا يجوز للرجل أن يجمع في عصمته أكثر من أربع زوجات وأيضا يجب أن يكون عادلا بينهّن وقادرا على الإنفاق عليهنّ، فأصبح التعدد مقيّد بتوفر ضوابط شرعية. لكن ما يلاحظ أنّ القوانين العربية فيما يتعلق بالتعدد اختلفت في تنظيمه، فمنها من تمسكت بهذه الضوابط الشرعية وهي شروط عامة، ومنها من اقتصرت على هذه الشروط لكن أضافت شروطا خاصة مثل قانون الأسرة الجزائري الذي اشترط على الزوج حصوله على موافقة الزوجة الأولى والثانية، وأيضا على وجود مبرر شرعي،و على ترخيص من القاضي بناء على سلطته التقديرية. The polygamy system is an ancient social system allowed by different laws and practiced by different peoples before Islamwithout restriction or condition, but with Islam advent, it was approved and adopted under some conditions, which restricted the number of wives to four and adopt justice between them, to put an end to injustice and rights deficiency. This restriction is highlighted in the interdiction for a man to don’t reunite more than four wives in his infallibility and must also be fair between them and able to spend money on them, so polygamy is restricted by Sharia barriers. However, what is noticed is that Arabic laws regarding polygamy differed in its regulation, some of them adhered to these legal barriers, which are general conditions, and some of them were limited to these conditions but added special conditions such as the Algerian family law, which stipulated: husband must obtain the approval of the first and second wife and also to the existence of a legitimate justification and on a judge license based on his discretionary authority
