مبادئ القانون الجنائي الدولي المطبقة على مرتكبي الجرائم الدولية

الملخص
لقد حاولت في هذا المقال تسليط الضوء على أهم مبادئ القانون الجنائي الدولي التي لا يمكن المساس أو التملص منها في حق من ارتكب جريمة دولية، أو الأخذ بها كأحد أهم موانع ودفع العقاب، إذ لا يمكن مثلا الدفع بمبدأ التقادم للإفلات من العقاب في نطاق الجرائم الدولية، وذلك حماية للأفراد والفئات الضعيفة، وفعلا توصلنا الى أهم توصية في بحثنا هذا وهي أنه كلما تم تطبيق هذه المبادئ تطبيقا سليما وعلى كل المجرمين، كلما تم احترام حقوق الانسان والأفراد أكثر، وزادت نسبة عدم الإفلات من العقاب بحجة التقادم أو غيرها من الحجج التي ناقشتها في هذا البحث. والغرض من تطبيق مبادئ القانون الجنائي الدولي تحقيق هدفين: الهدف الأول هو ضمان فرض العقاب على منتهكي حقوق الإنسان والقضاء على سياسات اللاعقاب والتي لا يمكن أن تكون الا عن طريق معاملة الكل سواسية أمام القانون، سواءا كانوا أفرادا أو دول، أما الهدف الثاني فهو يتمثل في تفعيل دور القواعد التجريمية الدولية في الحد من ارتكاب الجرائم الدولية وبالتالي تحقيق الهدف النهائي الذي يسعى إليه هذا القانون بإقامة عدالة دولية جنائية، وهو من أهم توصياتنا في هذه الورقة البحثية ضرورة تفعيل العقوبات. Abstract: In this article, I have tried to shed light on the most important principles of international criminal law that cannot be touched or eluded against the right of those who committed an international crime, or taken as one of the most important barriers and punishment, as it is not possible, for example, to push the principle of statute of limitations to impunity in the scope of international crimes And that is to protect individuals and vulnerable groups, and in fact we reached the most important recommendation in our research, which is that the more these principles are properly applied to all criminals, the more human and individual rights are respected, and the greater the percentage of impunity on the pretext of statute of limitations or other arguments discussed. In this research. The purpose of applying the principles of international criminal law is to achieve two goals: The first goal is to ensure punishment for violators of human rights and the elimination of impunity policies, which can only be done by treating everyone equally before the law, whether they are individuals or states. Activating the role of international criminal rules in limiting the perpetration of international crimes and thus achieving the ultimate goal sought by this law to establish international criminal justice, and one of our most important recommendations in this research paper is the necessity of enforcing penalties.
