الآليات الوقائية لمكافحة الفساد في القطاع العام (وفقا لاتفاقية الأمم المتحدة لسنة 2003

الملخص
نظرا لخطورة جرائم الفساد و انتشارها الرهيب بسرعة و حرصا منها لمكافحتها اعتمدت الدول الأطراف بموجب اتفاقيه الأمم المتحدة لمكافحه الفساد مجموعة من الاجراءات الاحترازية أو الوقائية تلتزم الدول بتطبيقها ضمن قوانينها الداخليه و وفقا للمبادئ الأساسية للنظام القانوني في القطاع العام حيث ترتكز هذه الاجراءات على حماية الادارة العامة و وسائلها من موظف عام ومرفق عام و أملاك عموميه من الانهيار و ذلك بتكريس مقومات النزاهة والشفافية والمساءلة اضافه الى اشراك المجتمع والتنظيمات في مكافحه الفساد ،كل ذلك لا يكون إلا بتجسيد سيادة القانون أو مبدأ المشروعيه. Abstract: Given the corruption crime seriousness and its terrible fast wide spreading, the states parties have adopted, under the United Nations’ agreement provisions, a set of precautionary and preventive measures to stand against this phenomenon that states must devote within their domestic laws in accordance with the basic principles of the law system in the public sector. These procedures are based on the protection of the general administration and its means, including the public employees, public utility and public property from collapsing by means of dedicating the element of integrity, transparency, and accountability, in addition to involving the society and organizations in combating corruption, all of which can only be achieved by embodying the sovereignty of law or the principle of legality.
