الملخص
الملخص: تناولت الدراسة موضوعا يندرج ضمن الجهود العلمية الساعية لتقوية الوظيفة التنفيذية للقانون الدولي في مجال حماية البيئة، وقد أبتدع خبراء القانون الدولي آلية عدم الامتثال لمعالجة القصور الذي يعتري حالات العجز في التنفيذ لالتزامات الدول الاطراف في اتفاقيات البيئية، وتجاوز صعوبات التنفيذ التي تشوب آليات عدم الامتثال واستيعابها قانونيا. وهي من الآليات التعاونية المؤسسية لتعزيز الامتثال ومعالجة صعوبات تنفيذ الاتفاقيات البيئية المتعددة الأطراف، وليست من الأدوات القسرية التي تتجنب الدول إستخدامها خوفا من أن تثار ضدها،وهي من إبتكار بروتوكول مونتريال للمواد المستنفذة لطبقة الأوزون سنة 1987، وتم تعميم هذه التجربة في الإتفاقيات الدولية اللاحقة مما يفيد أن هذه الآلية لقيت نجاحا وذات نجاعة وتساهم في فعالية تنفيذ الاتفاقيات الدولية لحماية البيئة .وعلى الرغم من النجاح الذي عرفته آليات عدم الامتثال فهي تواجهها صعوبات وتحديات تضعف من فعاليتها المطلوبة وبالتالي لابدمن تطوير أداءها حتى تصبح أكثر فعالية. Abstract: The study dealt with a topic that falls within the scientific efforts seeking to strengthen the executive function of international law in the field of environmental protection. International law experts have devised a mechanism for non-compliance to address the deficiencies in cases of deficiency in the implementation of the obligations of states parties to environmental agreements, and to overcome the difficulties of implementation that marred the mechanisms of non-compliance Legally. It is one of the institutional cooperative mechanisms for promoting compliance and addressing difficulties in implementing multilateral environmental conventions, not one of the coercive instruments that States were avoiding using for fear of being raised against, and had devised the Montreal Protocol on Substances that Deplete the Ozone Layer in 1987 ,This experience has been disseminated in subsequent international conventions, which suggest that the mechanism has been successful and effective and contributes to the effective implementation of international environmental protection conventions
