عقوبة العمل للنفع العام كبديل عن عقوبة الحبس قصير المدة

الملخص
تعتبر عقوبة العمل للنفع العام من أهم العقوبات البديلة المعاصرة التي لجأت إليها أغلب الدول في سياستها الجنائية، لأجل إصلاح وتأهيل المحكوم عليهم، وإعادة إدماجهم اجتماعيا، وقد اعتمد المشرع الجزائري هذا النمط من العقوبات، بموجب تعديل قانون العقوبات بالقانون 09- 01، باعتباره بديل عن عقوبة الحبس قصير المدة، مشترطا لتطبيقها جملة من الشروط. جاءت هذه الدراسة لأجل التعريف بهذه العقوبة، من خلال ما نص عليه المشرع وما أنتجه الواقع. La punition pour le bien public est l’une des peines alternatives les plus importantes à l’heure actuelle utilisée par la plupart des États dans leur politique pénale pour la réhabilitation et la réhabilitation des condamnés et leur réinsertion sociale. Le législateur algérien a adopté ce type de sanction dans le cadre de la modification de la loi 09-01 par le Code pénal, à la place de l'emprisonnement de courte durée, qui nécessitait l'application d'un certain nombre de conditions. Cette étude a pour objectif de définir la pénalité d’utilité publique, d’en définir les caractéristiques, ainsi que de définir les conditions et les procédures de mise en œuvre. The Penalty of the work for the public benefit is considered as one of the modern alternative sanctions that were beginning to resort to by the most of the countries in the criminal policy, In order to reform convicts and rehabilitation of convicts and re-integrate them into society. The Algerian legislature adopted this type of punishment under the amendment of the Penal Code by Law 09-01, as an alternative to short-term imprisonment, subject to the application of a number of conditions. This study aims at defining the public benefit penalty, defining its characteristics, as well as stating the conditions and procedures for its implementation.
