الملخص

قواعد البيانات مصنف رقمي أفرزته التطورات التكنولوجية، ويثير تداولها في البيئة الرقمية العديد من الإشكالات والصعوبات، لاسيما ما تعلق منها بسهولة التعدي عليها، والاستعمال غير المشروع لها من طرف قراصنة الفكر في العالم الافتراضي، وهو ما يشكل مساسا صارخا بالحق المعنوي لمؤلفها. لذا، كرس المشرع الجزائري حماية جزائية بهدف ردع هذه الأفعال غير المشروعة التي تتجسد في جريمة التقليد والجرائم الملحقة بالتقليد، وذلك في الأمر رقم 03-05 المتعلق بحقوق المؤلف والحقوق المجاورة، إلا أن هذه الحماية بقيت قاصرة أمام تطور أساليب التعدي في محيط رقمي يتصف بالتفاعلية والحركية، ما استدعى البحث عن آليات تتلاءم وخصوصية هذا المحيط من باب تدعيم هذه الحماية الردعية. Therefore, the Algerian legislator established penal protection with the aim of deterring these illegal acts that are embodied in the crime of imitation and crimes attached to imitation. This is in Ordinance No. 03-05 related to copyright and related rights; However, this protection remained limited to the development of methods of infringement in a digital environment characterized by interaction and movement, which necessitated the search for mechanisms that fit the specificity of this environment in order to strengthen this deterrent protection.
