الملخص
قد تناولنا من خلال هذه الدراسة مبدأ حسن النية في النظام القانوني للتأمين من المسؤولية المدنية للطبيب، حيث أن مبدأ حسن النية يعتبر من المبادئ الهامة في تصرفات القانونية والعلاقات الي تنشئ بين الأفراد ونظرا الأهمية هذا الموضوع والذي شغل باحثين القانونين ولقي اهتمام من الفقه والقضاء والمحامين وغيرهم من الرجال القانونين هو ما جعلنا نقسم هذه الدراسة إلى عنصرين رئيسين الأول هما تناولنا فيه مبدأ حسن النية في النظام القانوني للتأمين الطبي والثاني عالجنا فيه أثر مبدأ حسن النية على أحكام عقد التأمين في مجال الطبي وذلك لوقوف على أهم تغيرات والتطورات القانونية المساعدة على حماية الأطباء والمرضى من قبل شركة التأمين. Abstract: We have dealt through this study with the principle of good faith in the legal system to insure against the civil liability of the doctor, since the principle of good faith is one of the most important principles in the legal actions and relationships that arise between individuals. Given the importance of this topic, which raised the interest of legal researchers and received attention from jurisprudence, the judiciary, lawyers and other men of law, this study is divided into two main components. In the first, we dealt with the principle of good faith in the legal system of medical insurance. In the second, we dealt with the effect of the principle of good faith on the provisions of the insurance contract in the Medical field in order to identify the most important legal changes and developments that can help in the protection of doctors and patients by the insurance company.
