الرقابة على دستورية القوانين في ظل التعديل الدستوري لسنة 2020

الملخص
كرس المؤسس الدستوري في التعديل الدستوري لسنة 2020 رقابة على دستورية القوانين على نحو مخالف لما تضمنه التعديل الدستوري لسنة 2016، وذلك من عدة نواحي، إذ استبدل الهيئة التي كانت مكلفة بالرقابة وهي المجلس الدستوري بمؤسسة دستورية مستقلة وهي المحكمة الدستورية، تفصل هذه الأخيرة بقرار في رقابة المطابقة ورقابة الدستورية وآلية الدفع بعدم الدستورية، إذ لا وجود للرأي في الرقابة على دستورية القوانين كما كان في السابق. كما أن الرقابة أصبحت نوعان، رقابة سابقة وجوبية وجوازية ورقابة لاحقة جوازية، بالإضافة إلى إخضاع الأوامر لأول مرة لرقابة الدستورية، كما أصبحت المحكمة الدستورية تفصل في رقابة مطابقة القوانين العضوية بأغلبية مطلقة للأعضاء خلافا لباقي النصوص أين تطبق بخصوصها الأغلبية البسيطة، غير أن هذا لا يعني عدم احتفاظ المؤسس الدستوري ببعض القواعد والضوابط المتعلقة بالرقابة على دستورية القوانين على النحو الذي أقره التعديل الدستوري لسنة 2016. In the Constitutional Amendment of 2020, the constitutional founder devoted oversight over the constitutionality of laws in contravention of the provisions of the 2016 constitutional amendment, and in many respects, as he replaced the body that was in charge of the control, namely the Constitutional Council, with an independent constitutional institution, which is the Constitutional Court. Conformity oversight, constitutional control and the mechanism for defending unconstitutionality, as there is no opinion in monitoring the constitutionality of laws as it was in the past. In addition, supervision has become two types: ex-compulsory and permissible control and subsequent permissible control, in addition to subjecting orders for the first time to constitutional oversight, and the Constitutional Court has decided to control the conformity of organic laws with an absolute majority of members, unlike the rest of the texts where the simple majority applies, but this does not mean The constitutional founder does not maintain some rules and controls related to overseeing the constitutionality of laws as approved by the 2016 constitutional amendment.
