حرية التنقل في ظل جائحة كورونا بين ضرورة التقييد والحفاظ على الحرية

الملخص
أدى ظهور أولى الإصابات بوباء فيروس كورونا في الجزائر بالحكومة إلى اتخاذ جملة من التدابير الوقائية، التي وصلت لحد تعطيل حرية التنقل، وذلك من خلال تعليق نشاط نقل الاشخاص وفرض أنظمة الحجر المنزلي، غير أن الحكومة بعد مرور ثلاثة (3) أشهر عملت على تخفيف نظام الوقاية و تقليص القيود الواردة على حرية التنقل. ويتمثل الهدف من هذه الدراسة في محاولة إيجاد نوع من التوازن بين حرية التنقل المكفولة دستوريا وتدابير الضبط الإداري التي تهدف إلى حماية الصحة العامة باعتبارها مظهرا من مظاهر النظام العام، إذ استخدمت الدراسة المنهج الوصفي التحليلي بغرض الوصول إلى نتائج، من أهمها، اعتبار فيروس كورونا تهديدا للنظام العام في الدولة يتعين مواجهته بكل الوسائل الممكنة، كما أنه يتعين ضمان استمرارية ممارسة الحريات ومنها حرية التنقل وعدم تعطيلها لوقت طويل، ما يعني ضرورة احداث توازن بين ممارسة حرية التنقل وحماية الصحة العامة في المجتمع. The emergence of the first cases of the Coronavirus epidemic in Algeria led the government to take a number of preventive measures, which amounted to disrupting freedom of movement, by suspending the activity of transporting people and imposing home quarantine regulations. However, after three (3) months, the government worked to ease the Prevention and reduction of restrictions on freedom of movement. The aim of this study is to try to find a kind of balance between constitutionally guaranteed freedom of movement and administrative control measures aimed at protecting public health as a manifestation of public order, as the study used the descriptive and analytical approach in order to reach results, the most important of which is considering the Corona virus as a threat. The public order in the state must be confronted with all possible means, and the continuity of the exercise of freedoms, including freedom of movement, must be ensured and not disrupted for a long time, which means the need to strike a balance between exercising freedom of movement and protecting public health in society.
