الهيكل الإداري المكلف بإدارة الأوقاف في التشريع الجزائري

الملخص
الملخص: يتمثل الوقف في أنه حبس العين عن التمليك على وجه التأبيد والتصدق بالمنفعة على الفقراء، أو على وجه من وجوه البر أو الخير، ومعلوم أنه لنجاح أي استثمار يجب أن تتوفر الإدارة الحكيمة والتسيير الفعال. إن الجزائر مثلها مثل بقية الدول في العالم الإسلامي أنشأت جهازا إداريا قادرا على التسيير الأمثل للأوقاف التي بحوزتها، ومن خلال دراستنا هذه فنحن نهدف للتعرف على الأجهزة المكلفة بإدارة الأوقاف لنتمكن من فهم آليات عمليات الوقف وإجراءاته، حيث جعلها المشرع على مستويين مركزي ومحلي، كما سنتعرض لمدى قدرة هذه الأجهزة على أداء صلاحياتها ومهامها، لنصل إلى أن المشرع أحكم تنظيم الجهاز المكلف بإدارة الوقف. Abstract : The person who wants to protect a property from sale, donation, inheritance, and so on has a waqf, which is to block that property so that its benefits accrue to the poor and the charity. It is well known that every investment must have two essential elements: good governance and efficient management. Like other Muslim countries. Algeria has an administrative structure in charge of effectively managing the waqfs assets at its disposal, through this study, we aim to identify the bodies in charge of endowment management so that we can understand the mechanisms and procedures of the endowments, as the legislator made them at the central and local levels, in the end we will ensure the ability of these devices to the exercise of their powers and prerogatives, let us conclude that the legislator tightened the organization of the body responsible for administering the waqf.
