الجماية الجنائية للمسكن الإجتماعي في قانون العقوبات الجزائري

الملخص
ملخص المقالة: للإنسان الحق في أن يحيا حياته الخاصة بعيدا عن تدخل الغير و بمنأى عن العلانية ، فالحق في الحياة الخاصة من الحقوق التي قررتها مواثيق حقوق الإنسان و الدساتير والتشريعات المختلفة. و لاشك أن كفالة الحياة الخاصة للإنسان توفر له نوعا من الاستقرار و الأمن حتى يتمكن من أداء دوره الاجتماعي، فهو بحكم طبيعته له أسراره الشخصية و خصائصها المتميزة التي لا يمكن التمتع بها إلا في إطار مغلق يحفظها و يهيئ لها سبيل البقاء. ومن هنا كان الحق في حرمة الحياة الخاصة وجها لازما لحماية حقوق الإنسان لا ينفصل عنها ، بحيث أن لكل شخص الحق في ممارسة حياته بالكيفية التي يرغب فيها ، و ذلك ضمن مجالات متعددة و أهم هذه المجالات المسكن الذي يحظى بحرمة خاصة باعتباره مستودع سر الأفراد. وهذه الحرمة عرفتها المجتمعات منذ القدم والتي تعتبر قيدا يحمي الشخص من اعتداءات الآخرين بحيث لا يجوز دخول مسكن الغير دون إذن صاحبه و في غير الحالات المقررة قانونا. الكلمات المفتاحية: الحماية - الجنائية – المسكن – قانون - العقوبات – اجتماعي. Article Summary: Every person has the right to live his private life away from the interference of others and free from public life. The right to private life is one of the rights established by human rights charters, constitutions and various legislations. There is no doubt that ensuring the private life of a person provides him stability and security so that he can perform his social role, because by nature he has his personal secrets and distinctive characteristics that can not be enjoyed except in a closed frame that preserves and provides a way for them to survive. Hence, the right to inviolability of private life is a necessary aspect of the protection of human rights, so that everyone has the right to exercise his or her life in the manner in which he or she wishes, in a number of areas and the most important of these is sanctity of private residence, because its repository for the secret of individuals. This sanctity has been defined by societies since ancient times and is considered a restriction that protects the person from the attacks of others so that the residence of others can not be entered without the permission of the owner in cases other than those prescribed by law.
