الملخص
ملخص: جاء نص المادة 43 من التعديل الدستوري لسنة2016 ليكرس حرية الاستثمار والتجارة امتدادا للمادة 37 من دستور1996، لكن مع إعادة صياغة لمفردات كانت بتعويض مصطلح الصناعة بمصطلح الاستثمار، على اعتبار شمولية التجارة بمفهومها العام للصناعة، وبعض الإضافة للقيود الواردة عنها تتعلق بضوابط عامة لممارسة التجارة والاستثمار يحكمها الإطار القانوني بوجه عام فضلا عن التشديد على مبدأ المساواة. ومن مقتضيات حفظ النظام العام الاقتصادي تم إحداث قيدي مراعاة حقوق المستهلكين من جهة، وكذا احترام تشريع المنافسة،كما يجدر الارتقاء بحقوق بعض الفئات الأخرى التي تتأثر في الإمعان بتكريس الحرية الاقتصادية على غرار فئة العمال، ومهما يكن من أمر فإنه ثمة ضرورة للموازنة بين الحرية في ممارسة النشاط الاقتصادي دعما لاقتصاد قوي منتوع من جهة، ومراعاة للضوابط والقيود التي كرسها وأضافها التعديل الدستوري الأخير. Résumé: selon la dernier révision constitutionnel en 2016, l'article 43 consacrer la liberté du commerce et de l'investissement comme une extension de l'article 37 de la Constitution de 1996, mais avec la reformulation de certins vocabulaire et de l'additif aux limites établies par les limites généraux liés au commerce L'investissement est régi par le cadre juridique en général, ainsi que par le principe d'égalité. Et les exigences du maintien du l'ordre public économique a été imposent tenant compte des droits des consommateurs d'une part, ainsi que le respect de la législation de la concurrence et devrait promouvoir les droits de certains des autres groupes qui sont touchés par la persistance de consacrer la liberté économique comme la catégorie des travailleurs, et tous les cas, il était nécessaire d'équilibrer la liberté de l'activité économique et prendre en compte les contraintes etqui ont été inscrites dans le récent révision constitutionnel. Summary: According to the latest constitutional revision in 2016, Article 43 devotes freedom of trade and investment as an extension of Article 37 of the 1996 Constitution, but with the reformulation of certain vocabulary and the addendum to the limits established by the general limits related to trade Investment is governed by the legal framework in general, as well as by the principle of equality. And the requirements of the maintenance of the economic public order has been imposed taking into account the rights of the consumers on the one hand, as well as the respect of the legislation of the competition and should promote the rights of some of the other groups which are affected by the persistence of devoting economic liberty as the category of workers, and in all cases it was necessary to balance the freedom of economic activity and to take into account the constraints which were included in the recent constitutional revision.
