الملخص
ملخص يعتبر الحبس المؤقت إجراء خطير ضد الأشخاص ويتعارض من حيث الأساس مع حقوق الإنسان، إلا أن مقتضيات التحقيق القضائي قد تستدعي اللجوء إليه في حالات معينة. وهو ما يطرح مسألة ضرورة إحاطة مثل هذا الإجراء بضمانات تحافظ على تحقيق الأمن القضائي الذي يجب أن تتحلى به السلطة القضائية. الكلمات المفتاحية: تحقيق قضائي، ضمانات، مراقبة إلكترونية. Temporary confinement and its impact on judicial security Dr. Abdelkader HOUBA Abstract: Temporary confinement during the preliminary judicial investigation stage is a serious measure against persons and fundamentally incompatible with human rights. However, the requirements of the judicial investigation may require recourse to temporary detention procedure in certain cases. This raises the need for this procedure to be covered by guarantees to maintain judicial security. Key words: Judicial investigation, safeguards, electronic surveillance.
