الملخص
الملخص: يقدم هذا البحث تجلية وبيانا لقاعدة الذرائع عند الإمام مروان بن علي البوني ومدى تطبيقه لها في شرحه على موطّأ مالك، حيث تم التطرّق إلى ماهية ومفهوم الذريعة، وأنّ لها معنيان عام وخاص، ثمّ أنواع وأقسام الذريعة عند العلماء باعتباراتها المختلفة، إذْ اختلفت أنظار العلماء إلى الذريعة كلٌ حسب منهجه في الاجتهاد والتقعيد، بعدها تم إبراز مدى حجية هذه القاعدة عند المذاهب الأربعة، فكلّها كان لها نصيب من الاستدلال بها، بين مستقل ومستكثر، مع اختلافهم في الاصطلاح، حيث كان للمذهب المالكي الحظّ الأوفر من ذلك، ويليه المذهب الحنبلي، ثمّ الحنفي فالشافعي. أما في الشق الثاني من البحث فتمّ إبراز مدى تقرير البوني لقاعدة الذرائع من حيث تقييدها بالسدّ تارة، وبالفتح أخرى، وقد بيّن أنّها من الأصول الثابتة في المذهب المالكي، ثمّ أقام وحشد الأدلة على هذه القاعدة، من أحاديث وآثار، حيث لم يقصّر في تخريج الكثير من الفروع الفقهية على هذا الأصل، وتعليل أقوال الفقهاء عامة وأقوال مالك خاصة، وفي الأخير تمّ انتقاء وذكر بعض النماذج التطبيقية لهذه القاعدة من تفسيره على الموطّأ. Abstract: This research presents a clarification and clarification of the rule of pretexts by Imam Marwan bin Ali Al-Bawni and the extent of its application in his explanation of Muwatta Malik, where the nature and concept of the pretext was addressed, and that it has a general and specific meaning. Then the types and sections of the pretext according to the scholars with their different considerations, as the scholars’ attention to the pretext differed, each according to his method of ijtihad and recitation. All of them had their share of inference, between independent and abundant, with their differences in terminology, as the Maliki school had the most luck, followed by the Hanbali school, then the Hanafi school and then Shafi'i. As for the second part of the research, the extent of Al-Buni’s report on the rule of Dhar’i’ was highlighted in terms of restricting it to the dam at times, and to the conquest at other times. And then came out many branches of jurisprudence on this principle, and justified the sayings of the jurists, has been selected and mentioned some of the application models for this rule from its interpretation on the Muwatta.
