الملخص
الملخص: تعتبر العملات الافتراضية المشفّرة عامةً وعملة البتكوين خاصةً ظاهرة جديدة ومقلقة في الأوساط الاقتصادية عالميّا، فالانتشار المتسارع لها في الأسواق دعا إلى تقييم تداعياتها على كافّة الصُّعد، وقد سعيت في هذا البحث إلى تسليط الضّوء على النّاحية الشّرعية لهذه العملة، انطلاقا من البيانات المتاحة حولها من المصادر المختلفة - مفهوما وخصائصًا ومخاطرًا - وذلك باستخدام المنهج الوصفي، مستعينا بالاستقراء والتّحليل، حيث خلُص البحث إلى منع التّعامل بهذه العملة شرعاً؛ لما تشتمل عليه من أخطار وأضرار اقتصاديّة وتقنيّة وقانونيّة، وذلك حفاظاً على المقاصد المالية والشّرعية للدّول والأفراد؛ لأنّ الشريعة الغراء جاءت بحفظ الكليات الخمس ومنها المال، وحكم المنع مستمر مادامت أوصاف ومعطيات وملابسات هذه العملة على ما هي عليه إلى الآن، وقد يتغير الحكم بتطور هذه العملة وارتقائها إلى مستوى العملات التقليدية. Abstract: The encrypted virtual currencies in general and the Bitcoin currency in particular are considered a new and worrying phenomenon in the global economic circles. In this research, I sought to shed light on the legal aspect of this currency, based on the available data about it from various sources - concept, characteristics and risks - using the descriptive approach, using induction and analysis, Where the research concluded that dealing with this currency is legally prohibited; because of the economic, technical and legal risks and damages it entails, in order to preserve the financial and legitimate purposes of states and individuals; Because the noble Sharia came to preserve the five faculties, including money. The ruling of prohibition continues as long as the descriptions, data and circumstances of this coin remain as they are until now, and the ruling may change with the development of this coin and its elevation to the level of traditional currencies.
